PUBLIC NOTIFICATION -- TREE REMOVAL

We hope this finds you well. We are forwarding the attached public notification from the Urban Forestry Division (UFD) about a tree removal request the UFD has received that is in your Neighborhood Council area. Any individual or your Neighborhood Council can weigh in on the removal of the tree. If your Neighborhood Council elects to take official action, they can submit a letter to either Hector Banuelos or the Board of Public Works (see below).

The Urban Forestry Division (UFD) does try to avoid tree removals, particularly when there is no safety concern related to the tree, but objections by members of the public or a Council Office will be received by UFD. Those choosing to file an objection are recommended to include a course of action that includes an understanding of the tree’s health and condition are more likely to have an impact.

If the removal is for 1 or 2 trees, the UFD prefers that Neighborhood councils  raise objections within 3 days. In most cases, however, you have about 30 days to send in any objections to the removal. Just because a removal is being requested through this process does not indicate a decision has already been made. You are receiving this notification because the tree removal request has been elevated to the Chief Forester, who will be making the final decision. The Department of Neighborhood Empowerment recommends that Neighborhood Councils establish an Ad Hoc committee of up to two board members authorized to respond to tree removal notifications on behalf of the Board in these instances.

It is critical that any objections be sent to Hector Banuelos, hector[email protected], as well as your Council District Field Rep.  We recommend copying your CFAC representative (see attached list of representatives per CD below). Be sure to include the address where trees are located. 

Please do not reply to this email to challenge a tree removal.  Instructions on how to file a challenge are provided below.

If the removal is for 3 or more trees, the Board of Public Works will conduct a public hearing for the removal of the trees.   UFD is required to submit a report to the Board of Public Works for review and that report will be available with supplemental documents when the item is agendized and posted.

Would you like to receive notifications when a specific removal site is scheduled before the Board of Public Works? You are able to do so by clicking on the “Posting ID number” at this site.  You will get a screen to sign up to be notified when a Board hearing for the trees at that site is scheduled. 

Public comments should be submitted to the Board Secretariat via Google Form public comments, email to the EO, or telephone (live) oral testimony. You may either send a written comment, or call into the Zoom hearing and give public comment on the item.   If your Neighborhood Council has  submitted a Council Office or Neighborhood Council position letter in advance to [email protected]  (include hearing date and Posting ID number with the address) the Board of Public Works may give you longer speaking time.  Please note that if your board has not taken official action on the tree(s) removal, board members can only speak in their individual capacity with no additional time.

Esperamos que este correo electrónico los encuentre bien. Estamos reenviando la notificación pública adjunta de la División de Silvicultura Urbana (UFD por sus siglas en inglés) sobre una solicitud para la remoción de un árbol que la UFD ha recibido y que se encuentra en el área de su Concejo Vecinal. Cualquier individuo o su Concejo Vecinal puede opinar sobre la remoción del árbol. Si su Concejo Vecinal elige tomar una acción oficial, ellos pueden enviar una carta a Hector Banuelos o a la Junta de Obras Públicas (ver más abajo).

La División de Silvicultura Urbana trata de evitar la remoción de árboles, particularmente cuando no existe un problema de seguridad relacionado con el árbol, no obstante, la UFD recibirá objeciones de los miembros del público o de alguna Oficina del Concejo. Se recomienda a aquellos que elijan presentar
una objeción que incluyan un plan de acción que contenga un entendimiento de que la salud y condición del árbol son más probables que tengan repercusión.

Si la remoción es de 1 o 2 árboles, la UFD prefiere que los Concejos Vecinales presenten objeciones dentro de un período de 3 días. Sin embargo, en la mayoría de los casos, usted tiene aproximadamente 30 días para enviar cualquier objeción a la remoción. El hecho de que se solicite una remoción a través de este proceso no indica que ya se haya tomado una decisión. Usted está recibiendo esta notificación porque la solicitud de remoción del árbol se ha llevado ante el Jefe Forestal, quien tomará la decisión final. En estos casos, el Departamento de Fortalecimiento Vecinal recomienda que los Concejos Vecinales establezcan un comité Provisional de hasta dos miembros de la Junta, autorizados para que, en nombre de la Junta, respondan a las notificaciones de remoción de árboles. 

Es fundamental que cualquier objeción se envíe a Hector Banuelos, hector[email protected]  , así como a su Representante de Campo de su Distrito del Concejo. Recomendamos que envíe una copia a su representante del Comité Asesor de Bosques Comunitarios (CFAC por sus siglas en inglés), (consulte la lista adjunta de representantes por Distrito del Concejo abajo). Asegúrese de incluir la dirección donde se encuentran los árboles. 

Por favor no responda a este correo electrónico para oponerse a la remoción de un árbol. A continuación se proporcionan instrucciones sobre cómo presentar una objeción sobre la remoción de un árbol. 

Si la remoción es de 3 o más árboles, la Junta de Obras Públicas llevará a cabo una audiencia pública para la remoción de los árboles. la dirección), la Junta de Obras Públicas puede darle más tiempo para hablar. Por favor tenga en cuenta que si su Junta no ha tomado una acción oficial sobre la remoción del (de los) árbol(es), los Miembros de la Junta solo pueden hablar a título personal sin tiempo adicional.
